What are the benefits of a 1031 tax exchange?

A 1031 exchange can potentially provide investors access to different tax benefits, including deferred payment of capital gains, deferred payment of state income tax, and depreciation recapture on the investment. All opportunities should be discussed with a certified public accountant.

Is there a limit on how many times an investor can complete a 1031 exchange?

There is currently no limit on the number of 1031 exchanges an investor can complete. Investors in the United States, including those in New York, can roll over their investment property gains to another asset and continue to defer capital gains.

What happens when I sell a 1031 exchange property?

When investors sell a 1031 exchange property, they have the option to trade into another property via another 1031 exchange or cash out and pay capital gains. However, if selling an exchange property, investors must be prepared to select a qualified intermediary (QI) to hold the funds of the property’s sale. If an investor takes hold of those funds, the investor can no longer complete an exchange.

How soon can I refinance a 1031 exchange property?

There are no set restrictions on how long a property owner must wait to refinance an asset following a 1031 exchange. In fact, many investors leverage refinancing to further improve their position after the exchange.

What is a Delaware Statutory Trust?

A Delaware Statutory Trust (DST) is a business trust that can be used for real estate ownership of a higher quality, professionally managed commercial property. Per the Internal Revenue Service (IRS), DSTs are recognized as a qualified replacement property for real property, thereby providing a passive, turn-key solution for transacting a 1031 exchange.
